{"id":807,"date":"2023-01-26T12:46:50","date_gmt":"2023-01-26T17:46:50","guid":{"rendered":"https:\/\/nakedpolitics.net\/?p=807"},"modified":"2023-01-26T12:47:11","modified_gmt":"2023-01-26T17:47:11","slug":"20-states-sue-biden-admin-over-illegal-visa-system","status":"publish","type":"post","link":"https:\/\/nakedpolitics.net\/?p=807","title":{"rendered":"20 States Sue Biden Admin Over \u2018Illegal Visa System\u2019"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Twenty states led by Texas sued the Biden administration Tuesday over another immigration policy they argue is illegal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A new U.S. Department of Homeland Security\u00a0 program \u201cunlawfully creates a de facto pathway to citizenship for hundreds of thousands of aliens,\u201d Texas Attorney General Ken Paxton argues, referring to a plan President Joe Biden\u00a0<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.thecentersquare.com\/national\/immigration-parole-program-biden-says-he-s-expanding-already-faces-legal-challenge\/article_e91e8fe8-8d58-11ed-b439-9bb3e7a9e0f5.html\" target=\"_blank\">announced<\/a><\/strong>\u00a0Jan. 5.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of the plan involves expanding a parole system to allow an additional 360,000 foreign nationals in the country illegally to be released into the United States, a system over which Florida already sued. Florida\u2019s case went to trial on the same day Biden announced he was expanding the very system Florida is asking a judge to halt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed expansion allows up to 30,000 Cubans, Haitians, Nicaraguans and Venezuelans to enter the U.S. a month, and requires Mexico to hold another roughly 30,000 a month at U.S. taxpayer expense. The president claimed those illegally entering between ports of entry from these four countries would be returned to Mexico. Those who apply for work permits could receive a two-year authorization to live in the U.S., according to the program. If the law established by Congress was enforced, the majority of people applying to this program would be denied entry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plan applies to citizens of four countries who\u2019ve increasingly entered the U.S. illegally since Biden\u2019s been in office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In fiscal 2022 and the first three months of fiscal 2023, for example, a\u00a0<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.thecentersquare.com\/florida\/surge-in-illegal-immigration-from-cuba-haiti-to-florida-continues\/article_e5083af0-9c24-11ed-92bd-6b8e5574fb0b.html\" target=\"_blank\">record number<\/a><\/strong>\u00a0of Cubans and Haitians have been apprehended by the U.S. Coast Guard and Border Patrol agents attempting to illegally enter Florida. Likewise, a record number of Nicaraguans and Venezuelans have been apprehended at the southern border, according to Customs and Border Protection data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Jan. 5, DHS Secretary Alejandro Mayorkas again&nbsp;<strong><a href=\"https:\/\/www.thecentersquare.com\/texas\/mayorkas-says-border-is-closed-ahead-of-biden-trip-to-el-paso\/article_d159752c-8f82-11ed-931b-232d3baa1290.html\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a><\/strong>&nbsp;\u201cthe border was closed\u201d and expanding the parole system would \u201cprovide humanitarian relief consistent with our values, cut out vicious smuggling organizations, and enforce our laws.\u201d He also said, \u201cIndividuals without a legal basis to remain in the United States will be subject to prompt expulsion or removal. Individuals who are provided a safe, orderly, and lawful path to the United States are less likely to risk their lives traversing thousands of miles in the hands of ruthless smugglers, only to arrive at our southern border and face the legal consequences of unlawful entry.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paxton argues the program is illegal because Congress only authorized parole \u201cfor foreign aliens who meet very specific standards that have not been met in this instance. Yet, contrary to existing law, the program creates a pathway for program participants to apply from their home country and gain lawful status to enter and stay in the U.S. for up to two years, or even longer.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like the previous expansion of the parole system, this program was implemented \u201cwithout engaging in the usual notice and comment rulemaking process required by law,\u201d Paxton argues, which is \u201cyet another episode in which the administration has abused its executive authority in furtherance of its apparent objective for immigration policy: open borders and amnesty for all.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paxton said Biden\u2019s border policies are creating a humanitarian crisis and major problems for border states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEvery state in America, especially border states like Texas, is being crushed by the impacts of illegal immigration,\u201d he said. \u201cThe Biden open borders agenda has created a humanitarian crisis that is increasing crime and violence in our streets, overwhelming local communities, and worsening the opioid crisis. This unlawful amnesty program, which will invite hundreds of thousands of aliens into the U.S. every year, will only make this immigration crisis drastically worse.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<strong><a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Complaint%20-%20Filed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a><\/strong>&nbsp;notes that the parole system can only be applied on a \u201ccase-by-case basis for urgent humanitarian reasons or significant public benefit,\u201d not en masse as it\u2019s been used or is being proposed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe parole program established by the department fails each of the law\u2019s three limiting factors. It is not case-by-case, is not for urgent humanitarian reasons, and advances no significant public benefit. Instead, it amounts to the creation of a new visa program that allows hundreds of thousands of aliens to enter the United States who otherwise have no basis for doing so. This flouts, rather than follows, the clear limits imposed by Congress,\u201d the complaint states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit was filed in U.S. District Court Southern District of Texas Victoria Division. The defendants include Mayorkas, U.S. Citizenship and Immigration Services Director Ur Jaddou, U.S. Customs and Border Protection Acting Commissioner Troy Miller, and Acting Director of U.S. immigration and Customs Enforcement Tae Johnson, and their respective agencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs, joining Paxton, include the attorneys general of Alabama, Alaska, Arkansas, Florida, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, South Carolina, Tennessee, Utah, West Virginia and Wyoming.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seven of them, including Paxton, joined Florida Attorney General Ashley Moody last year in&nbsp;<strong><a href=\"https:\/\/www.thecentersquare.com\/national\/14-attorneys-general-demand-dhs-secretary-mayorkas-resign-over-border-crisis\/article_ad0c7986-9441-11ec-8afc-7f01801ab7e9.html\" target=\"_blank\" rel=\"noreferrer noopener\">calling<\/a><\/strong>&nbsp;on Mayorkas to resign. Texas congressional members have called for him to be impeached, arguing he is willfully not enforcing laws established by Congress and has violated his oath of office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite Mayorkas\u2019 dismissal of their claims, and repeated claim that \u201cthe border is secure,\u201d under his watch, the greatest number of known\u00a0<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.thecentersquare.com\/national\/border-patrol-agents-apprehend-38-known-terrorists-in-first-3-months-of-fiscal-2023\/article_2bc101f0-9b78-11ed-aaeb-bfcbb093f6e7.html\" target=\"_blank\">terrorists<\/a><\/strong>\u00a0have been apprehended illegally entering the U.S. on record.
