She subsequently filed a lawsuit against Southwest and won.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July of last year, a jury decided that Southwest wrongfully terminated Carter on the grounds of religious discrimination. That jury also instructed the company to reinstate the flight attendant and awarded her $4.15M in back pay, pain and suffering, and additional costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge reduced that penalty substantially to $810,180, citing limitations on damages allowed by federal discrimination laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge also issued a mandate for the airline to notify all employees of their rights against religious discrimination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, Southwest sent an internal company memo detailing exactly why Carter was terminated.<br>As such, District Court Judge Brantley Starr instructed the training with Alliance Defending Freedom.<br>According to&nbsp;<a href=\"https:\/\/www.nbcnews.com\/business\/business-news\/southwest-airlines-religious-liberty-training-carrier-appeals-order-rcna99012?cid=sm_npd_nn_tw_ma&amp;taid=64d3bf1a66d1df0001123362&amp;utm_campaign=trueanthem&amp;utm_medium=social&amp;utm_source=twitter\" target=\"_blank\" rel=\"noreferrer noopener\">NBC News<\/a>, the judge has given the three until August 28, 2023 to attend and complete the eight-hour block of training.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per the&nbsp;<a href=\"https:\/\/simpleflying.com\/southwest-airlines-appeal-judges-ruling-religious-freedom-training\/\" target=\"_blank\" rel=\"noreferrer noopener\">Simple Flying website<\/a>, Starr\u2019s decision stated, \u201cThe Court concludes that training on religious freedom for three lawyers at Southwest the Court finds responsible (Kerrie Forbes, Kevin Minchey, and Chris Maberry) is the least restrictive means of achieving compliance with the Court\u2019s order.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legal experts are now debating as to whether the judge\u2019s appointment of ADF was an overreach on his part, or if they should have found a \u201cless polarizing\u201d group to facilitate the training.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">A federal judge has set off a debate among legal scholars by ordering lawyers for Southwest Airlines to undergo \u201creligious-liberty training\u201d by a conservative Christian legal group.<br><br>Critics say that if the judge believes such training is necessary, he should have found a less\u2026 <a href=\"https:\/\/t.co\/wPF0otZqYu\">pic.twitter.com\/wPF0otZqYu<\/a><\/p>&mdash; \ud835\udd42\ud835\udd63\ud835\udd5a\ud835\udd64\ud835\udd65\ud835\udd5a\ud835\udd5f\ud835\udd4a\ud835\udd61\ud835\udd56\ud835\udd54\ud835\udd5a\ud835\udd52\ud835\udd5d\ud835\udd42 (@CallMeK1123) <a href=\"https:\/\/twitter.com\/CallMeK1123\/status\/1691032845173522432?ref_src=twsrc%5Etfw\">August 14, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Others argue that the ruling could be a violation of the attorney\u2019s Constitutional rights, especially if they espouse different religious practices apart from the Christian faith.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe court is moving into some really dangerous territory here,\u201d said David Lopez, a law professor at Rutgers University in New Jersey, and former counsel under the Obama administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ADF chief legal counsel, Jim Campbell, issued a statement, saying in part that his group was happy to help provide the training needed to educate companies on laws barring religious discrimination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEvery company should respect religious liberty and diverse viewpoints in the workplace,\u201d the statement said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the ADF is a conservative, Christian organization, they state on their website that they \u201cpromote the freedom of every person to live out their religious convictions in the public square, just as in the home or a place of worship.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Southwest plans to appeal the decision, arguing that there is no need for religious freedom training and that it actually did comply with the judge\u2019s order, while also saying that they could provide a corrective notice to the memo they issued to employees to include the notification of rights against discrimination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSouthwest Airlines has a demonstrated history of supporting our employees\u2019 rights to express their opinions when done in a respectful manner.
