Pritzker (D-IL) signed into effect legislation that flagrantly violates the Second Amendment to the U.S. Constitution by broadly banning the sale and distribution of the entire class of semi-automatic weapons. In addition to semi-automatic weapons, so-called \u201chigh-capacity magazines,\u201d and switches are also banned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pritzker has claimed \u201cThis will save lives,\u201d according to&nbsp;<a href=\"https:\/\/www.newsmax.com\/newsfront\/guns-ban-second-amendment\/2023\/01\/10\/id\/1103884\/?fbclid=IwAR0qsqnSrpXXMPLcyBD-02rn01CdukNPrOxSUZLbZRkg5-EaCtln6p8xy9o&amp;mibextid=Zxz2cZ\" rel=\"noreferrer noopener\" target=\"_blank\">Newsmax<\/a>&nbsp;in spite of Chicago simultaneously having one of the most aggressive gun-control regimes in America and by far and away the highest&nbsp;<a href=\"https:\/\/dcenquirer.com\/chicago-crime-police-lori-lightfoot-antifa\/\" target=\"_blank\" rel=\"noreferrer noopener\">murder rate<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Democrat tweeted, \u201cI\u2019m tired of living in a world where a mass shooting needs a title so you know which one we\u2019re referring to.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNo Illinoisan should have to go through life fearing their loved one could be next in an ever-growing list of mass shooting victims. We will keep fighting to ensure that future generations only hear about massacres like Highland Park, Sandy Hook, and Uvalde in their textbooks,\u201d he added.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">I&#39;m tired of living in a world where a mass shooting needs a title so you know which one we&#39;re referring to. <br>  <br>I just signed the Protect Illinois Communities Act, which immediately bans the sale and distribution of assault weapons, high-capacity magazines, and switches in IL. <a href=\"https:\/\/t.co\/xvVfrlLSaU\">pic.twitter.com\/xvVfrlLSaU<\/a><\/p>&mdash; Governor JB Pritzker (@GovPritzker) <a href=\"https:\/\/twitter.com\/GovPritzker\/status\/1613005039739478018?ref_src=twsrc%5Etfw\">January 11, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The new law stands to face significant challenges in court as it directly violates the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/#tab-opinion-1962738\" target=\"_blank\">ruling<\/a>\u00a0of DC v. Heller that reversed a handgun ban in Washington, D.C. In that groundbreaking ruling, Justice Scalia writing for the majority wrote,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe handgun ban amounts to a prohibition of an entire class of \u201carms\u201d that is overwhelmingly chosen by American society for that lawful purpose. The prohibition extends, moreover, to the home, where the need for defense of self, family, and property is most acute. Under any of the standards of scrutiny that we have applied to enumerated constitutional rights,[<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/#F27\" rel=\"noreferrer noopener\" target=\"_blank\">Footnote 27<\/a>] banning from the home \u201cthe most preferred firearm in the nation to \u2018keep\u2019 and use for protection of one\u2019s home and family,\u201d 478 F. 3d, at 400, would fail constitutional muster.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.ammunitiondepot.com\/blog\/what-percentage-of-guns-in-the-us-are-semiautomatics#:~:text=The%20ATF%20data%20for%20the,percentage%20comes%20to%20about%2017%25.\" rel=\"noreferrer noopener\" target=\"_blank\">AmmunitionDepot<\/a>&nbsp;wrote that \u201cGiven the numbers that are available, it\u2019s possible to determine a ballpark figure of total semiautomatic guns owned in the United States [\u2026] The NSSF shows 17.7 million modern sporting rifles produced from 1990-2017.&nbsp;ATF data for the same timeframe on pistols is just over 52.4 million. Those combined equal to around 70.1 million semiautomatic handguns and rifles. If that\u2019s divided by the 423 million firearms owned, the percentage comes to about 17%.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This undercuts the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/dcenquirer.com\/police-shootings-13-officers-shot\/\" target=\"_blank\">Illinois<\/a>\u00a0ban in two separate and seemingly contradictory ways, at least on the surface. First, at 17% of all firearms purchased in the U.S., the status of semi-automatic firearms as \u201can entire class of \u2018arms\u2019 that is overwhelmingly chosen by American society for that lawful purpose,\u201d as stated by Justice Scalia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conversely, if only 17% of all firearms purchased are\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/dcenquirer.com\/americans-love-guns-so-much\/\" target=\"_blank\">semi-automatic<\/a>, what benefit to gun crime prevention is there in only pulling a maximum of 17% of firearms off the streets?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newsmax noted that many critics warn the law is ripe for court challenges that will ultimately overturn it. State Rep. Blaine Wilhour, a Republican from Beecher City, told the outlet, \u201cA government willing to defy our Constitution is a government that is completely out of control. So you can sit here and dictate whatever you want today. But I can tell you that we will not comply and you\u2019re not going to do a darn thing about it because the law, the Constitution, and the founding principles are on our side.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reportedly the new law bans dozens of specific brands and models of rifles and handguns.
