Perhaps the most significant of these occurred a year ago, when the United States Supreme Court handed down its&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\">opinion<\/a>&nbsp;in&nbsp;<em>West Virginia v. E.P.A.<\/em>, overturning the Obama-Biden \u201cClean Power Plan.\u201d That regulatory monstrosity capped greenhouse gases from electricity production with the express purpose of forcing \u201cgeneration shifting,\u201d from coal to so-called renewable sources. It was an administrative overreach which proved to be the rule\u2019s undoing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As it was being challenged at the Court, the Biden administration pleaded that they leave it be, since a replacement was already in the works. Thankfully,\u00a0the Court gave the matter a look.\u00a0The 6-3 majority in\u00a0<em>West Virginia<\/em>\u00a0did not, as Justice Kagan\u2019s dissent insisted, install guardrails via the announcement of a new doctrine. Instead, the Court splashed bright neon paint on guardrails that had been there all along, even if they were often ignored.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full\"><img decoding=\"async\" src=\"data:image\/svg+xml,%3Csvg%20xmlns='http:\/\/www.w3.org\/2000\/svg'%20viewBox='0%200%20370%20247'%3E%3C\/svg%3E\" data-lazy-src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-82.png\" alt=\"\" class=\"zeen-lazy-load-base zeen-lazy-load wp-image-3866\"\/><noscript><img decoding=\"async\" width=\"296\" height=\"300\" src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-82.png\" alt=\"\" class=\"wp-image-3866\" srcset=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-82.png 296w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-82-100x100.png 100w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-82-293x297.png 293w\" sizes=\"(max-width: 296px) 100vw, 296px\" \/><\/noscript><figcaption class=\"wp-element-caption\">Even Marilyn needed guardrails.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">The decision was a robust affirmation of what is known as the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Major_questions_doctrine#:~:text=The%20major%20questions%20doctrine%20is,major%20political%20or%20economic%20significance.\">Major Questions Doctrine<\/a>. It stated that \u201c[c]apping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal to generate electricity\u00a0<em>may<\/em>\u00a0be a sensible \u2018solution to the crisis of the day.\u2019\u201d (Emphasis added.) However, when an agency undertakes \u201cdecision[s] of such economic and political significance, i.e., how much coal-based generation there should be over the coming decades,\u201d courts should employ a &#8220;raised eyebrow&#8221; test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is, on questions of this magnitude \u201c<a href=\"https:\/\/content.time.com\/time\/subscriber\/article\/0,33009,898883,00.html\">penumbras formed by emanations<\/a>\u201d won\u2019t cut it.&nbsp;In this case the justification was an obscure section of the&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Clean_Air_Act_(United_States)\">Clean Air Act of 1963<\/a>, rarely used but now purportedly an authorization for the Executive branch to instruct Americans how they might purchase their electricity. Thankfully the Court&#8217;s majority remembered the wisdom of their departed colleague Antonin Scalia, who once said in a&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/supct\/pdf\/99-1257P.ZO\">relevant case<\/a>&nbsp;that&nbsp;Congress \u201cdoes not&#8230; hide elephants in mouseholes.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This ought to spell trouble for the &#8220;climate&#8221; agenda long-term. Going forward regulatory policies intended to massively shift the nation away from fossil fuels should trigger this review for clear authorization by Congress.&nbsp;Unfortunately Clean Air Act cases by statute first go to the D.C. Circuit Court which was&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/SB10001424127887323628004578456872854815956\"><em>expanded<\/em><\/a>under President Obama. This process prolongs Supreme Court resolution and gives the permanent bureaucracy time to do a great deal of damage before the Court can step in, assuming it does.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The E.P.A. is now being counseled to downplay confessions of broader purpose and claims to have discovered authorities in obscure statutory provisions. That was the key takeaway from a rather\u00a0<a href=\"https:\/\/www.eli.org\/events\/west-virginia-v-epa-analyzing-supreme-courts-decision\">glum panel<\/a>\u00a0hosted by the Environmental Law Instituted two weeks after the\u00a0<em>West Virginia<\/em>\u00a0decision, entitled\u00a0\u201c<em>West Virginia v. EPA<\/em>: Analyzing the Supreme Court\u2019s Decision.\u201d At that event Kevin Poloncarz of Covington &amp; Burling counseled participants \u201cAgencies might be wise if they are going to employ existing tools, to not make political announcements and to [instead] say they are swimming in their lane.\u201d To be clear, he added, \u201c[w]e don\u2019t want the political appointees to get out in front of the lawyers.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-full\"><img decoding=\"async\" src=\"data:image\/svg+xml,%3Csvg%20xmlns='http:\/\/www.w3.org\/2000\/svg'%20viewBox='0%200%20370%20247'%3E%3C\/svg%3E\" data-lazy-src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81.png\" alt=\"\" class=\"zeen-lazy-load-base zeen-lazy-load wp-image-3865\"\/><noscript><img decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81.png\" alt=\"\" class=\"wp-image-3865\" srcset=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81.png 300w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81-293x195.png 293w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81-120x80.png 120w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-81-240x160.png 240w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/noscript><figcaption class=\"wp-element-caption\">Slow and steady wins the race.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Taking this advice, an insidious new approach to imposing the &#8220;green&#8221; agenda has arisen. That is using back door approaches \u2014 claiming to be merely\u00a0<em>tightening<\/em>\u00a0existing standards. All of them, and with the object of driving politically disfavored energy sources to closure.\u00a0We know this in part because E.P.A. administrator Michael Regan\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/power-plants-environmental-protection-agency-rule-epa-biden-administration-fossil-fuels-60f06bd0\">admitted<\/a>\u00a0it. Regan said that, \u201cBy presenting all of those rules at the same time to the industry, the industry gets a chance to take a look at this suite of rules all at once and say, \u2018Is it worth doubling down in investments in this current facility? Or should we look at that cost and say now it\u2019s time to pivot and invest in a clean energy future?\u2019\u201d\u00a0Chances are Regan would take that statement back if he could. But the cat&#8217;s out of the bag.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two years ago a lead&nbsp;<em>Wall Street Journal<\/em>&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/bidens-backdoor-climate-plan-11616020338\">editorial<\/a>&nbsp;entitled \u201cBiden\u2019s \u2018Back Door\u2019 Climate Plan,\u201d set forth how emails and slideshow attachments obtained through open records requests and litigation revealed this very strategy of the incoming administration. The editorial summarized in just over 800 words a 25-page amicus&nbsp;<a href=\"https:\/\/govoversight.org\/wp-content\/uploads\/2021\/07\/21-1028_State-of-NY-v-EPA_Brief-for-Amicus.pdf\">brief<\/a>&nbsp;this writer had just filed in the D.C. Circuit on behalf of Energy Policy Advocates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was the brainchild of a man named&nbsp;<a href=\"https:\/\/www.epa.gov\/senior-leaders-calendars\/calendar-joseph-goffman-principal-deputy-assistant-administrator-office\">Joseph Goffman<\/a>, who had midwifed the Clean Power Plan for President Obama before joining an activist group at Harvard. There he counseled progressive state attorneys general on how to impose climate regulations stealthily. Goffman is has since returned to E.P.A. and set to work doing just that.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe class=\"zeen-lazy-load-base zeen-lazy-load\" title=\"Clean Power Plan Explained\" width=\"1200\" height=\"675\" src=\"about:blank\" data-lazy-src=\"https:\/\/www.youtube.com\/embed\/AcNTGX_d8mY?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe><noscript><iframe title=\"Clean Power Plan Explained\" width=\"1200\" height=\"675\" src=\"https:\/\/www.youtube.com\/embed\/AcNTGX_d8mY?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe><\/noscript>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">As the&nbsp;<em>Journal<\/em>&nbsp;pointed out, Goffman was&nbsp;<a href=\"https:\/\/www.eenews.net\/articles\/meet-the-man-tasked-with-carrying-out-bidens-air-agenda\/\">hailed<\/a>&nbsp;as the \u201cE.P.A.\u2019s law whisperer. His specialty is teaching an old law to do new tricks.&#8221; But<em>&nbsp;<\/em><a href=\"https:\/\/wattsupwiththat.com\/2023\/03\/05\/law-whispering-is-dead-long-live-law-whispering\/\"><em>law whispering<\/em><\/a>&nbsp;was precisely what the Justices smacked down in&nbsp;<em>West Virginia<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Through Freedom of Information Act litigation, Energy Policy Advocated also obtained an E.P.A. PowerPoint&nbsp;<a href=\"https:\/\/wattsupwiththat.com\/2023\/03\/05\/law-whispering-is-dead-long-live-law-whispering\/\">slideshow<\/a>, now sitting before the D.C. District Court on summary judgment to find out how much more if any the Agency has to release of its contents. Titled \u201c<a href=\"https:\/\/www.eenews.net\/articles\/inside-epas-climate-strategy-for-power-plants\/\">Power Sector Strategy: Climate, Public Health, Environmental Justice \u2014 the Building Blocks<\/a>,\u201d it was created and presented by Goffman to the White House Climate Office two weeks after the inauguration. The slideshow lays out a series of non-climate regulatory programs, never authorized to be used to reduce greenhouse gases, which the &#8220;Law Whisperer&#8221; proposed&nbsp;should&nbsp;be used for just that purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The E.P.A. is keeping the details of most of the slides, including \u201cNext Steps for Coal-fired Power Plants\u201d \u2014 the mere heading of which the Agency also initially withheld \u2014 hidden behind a wall of redactions claiming privilege, and that the public would be confused if it saw E.P.A. discussing things we now know it cannot do.\u00a0Whatever the Court does, the Republican House majority should use its oversight authority to obtain an unredacted version of these slides. This would aide Congress in performing its own duties, and also help the courts to prepare for the inevitable litigation over each of this \u201csuite of rules.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-full\"><img decoding=\"async\" src=\"data:image\/svg+xml,%3Csvg%20xmlns='http:\/\/www.w3.org\/2000\/svg'%20viewBox='0%200%20370%20247'%3E%3C\/svg%3E\" data-lazy-src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80.png\" alt=\"\" class=\"zeen-lazy-load-base zeen-lazy-load wp-image-3864\"\/><noscript><img decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80.png\" alt=\"\" class=\"wp-image-3864\" srcset=\"https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80.png 300w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80-293x195.png 293w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80-120x80.png 120w, https:\/\/nakedpolitics.net\/wp-content\/uploads\/2023\/06\/image-80-240x160.png 240w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/noscript><figcaption class=\"wp-element-caption\">Sorry not sorry.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Meanwhile we see a serious effort&nbsp;to \u201c<a href=\"https:\/\/www.aier.org\/article\/the-new-normaling-of-blackouts\/\">new-normalize blackouts<\/a>,\u201d whose likelihood and severity is being encouraged by the Biden E.P.A. \u2014 and indeed, the entire administration in a \u201cwhole of government\u201d&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/01\/27\/fact-sheet-president-biden-takes-executive-actions-to-tackle-the-climate-crisis-at-home-and-abroad-create-jobs-and-restore-scientific-integrity-across-federal-government\/\">approach<\/a>&nbsp;to imposing an agenda never approved by Congress. The messaging point has&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/business\/2023\/05\/17\/blackout-risk-summer-heat-grid\/\">already<\/a>&nbsp;gone out that when the engineered disasters come,&nbsp;<em>well, it\u2019s just that damn severe weather<\/em>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reliability concerns, as well as infeasibility, were issues in&nbsp;<em>West Virginia.<\/em>&nbsp;They will be again. As will law whispering. The Court should know all of the relevant details about E.P.A.\u2019s backdoor scheme when it tackles this latest wave of regulatory abuse.
