There are conflicting reports about how long Neely was restrained:&nbsp;<a href=\"https:\/\/nypost.com\/2023\/05\/05\/how-jordan-neelys-subway-chokehold-death-unfolded\/\" target=\"_blank\" rel=\"noreferrer noopener\">One witness said 15 minutes<\/a>, but that seems highly unlikely given the distance between stops.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shortly after the Marine, Daniel Penny, released Neely, the homeless man stopped breathing. He was taken to the hospital and pronounced dead.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Manhattan District Attorney Alvin Bragg\u2019s office hasn\u2019t pressed charges as of this story\u2019s publication, but a grand jury could be called on this week to decide if the Marine is to be indicted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neely was black and Penny is white.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It didn\u2019t take long before \u201cthe squad,\u201d as a group of liberal House lawmakers has been dubbed, got ahold of the story, and soberly explained that the situation on the subway was complicated and it would wait for facts before casting judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ha!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just kidding. The squad did exactly<a rel=\"noreferrer noopener\" href=\"https:\/\/thespectator.com\/topic\/squad-stands-alone-jordan-neely-death\/\" target=\"_blank\">\u00a0what you would expect<\/a>. It immediately rushed to social media to ensure that the story fit the Narrative, declared the Marine a murderer, and insisted that Neely was killed because of racism. It disrupted the trains and was<a href=\"https:\/\/gothamist.com\/news\/protesters-cops-clash-at-manhattan-subway-station\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;charged with various crimes<\/a>, including assault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The story is getting a lot of massaging from the media, where headlines describe Neely in the best possible light. He was a beloved street performer\u2014a Michael Jackson impersonator\u2014from a family of musicians, a little down on his luck because of a rough childhood.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This from USA Today:<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Jordan Neely, a beloved subway performer, grew up in a family of musicians who want him to be remembered as a &quot;human being,&quot; a family lawyer said.  <a href=\"https:\/\/t.co\/mXJVudDMpF\">https:\/\/t.co\/mXJVudDMpF<\/a><\/p>&mdash; USA TODAY (@USATODAY) <a href=\"https:\/\/twitter.com\/USATODAY\/status\/1655232284440551425?ref_src=twsrc%5Etfw\">May 7, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">And CNN:<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Jordan Neely, the man who died last week after being held in a chokehold on a New York City subway, was on a list of homeless people identified as having dire needs<a href=\"https:\/\/t.co\/dHdRoEiPPK\">https:\/\/t.co\/dHdRoEiPPK<\/a><\/p>&mdash; CNN (@CNN) <a href=\"https:\/\/twitter.com\/CNN\/status\/1655516669966516231?ref_src=twsrc%5Etfw\">May 8, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">As the details emerge, it\u2019s quite clear that Neely wasn\u2019t just a beloved subway moonwalker bringing joy and happiness to commuters before being lynched by a hateful white supremacist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The<a href=\"https:\/\/www.nytimes.com\/2023\/05\/07\/nyregion\/jordan-neely-daniel-penny-nyc-subway.html\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;New York Times noted<\/a>&nbsp;that Neely had racked up dozens of arrests in recent years while exhibiting bizarre and dangerous behaviors after he began taking K2, which is synthetic marijuana. Neely had been arrested for, among other things, punching a 67-year-old woman in the face and allegedly attempting to kidnap a 7-year-old he was found<a href=\"https:\/\/www.nydailynews.com\/new-york\/nyc-crime\/ny-possible-charges-marine-michael-jackson-impersonator-jordan-neely-20230504-plaznkv5pjbuxaqdu2tlxpieqq-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;dragging down the street<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case where he punched the woman coming out of an East Village subway stop he \u201cpleaded guilty and received an alternative-to-incarceration program that let him dodge jail,\u201d<a href=\"https:\/\/www.foxnews.com\/us\/911-timeline-moments-before-marine-vet-put-jordan-neely-chokehold-nyc-subway\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;according to Fox News<\/a>. The felony assault charge would have been reduced to a misdemeanor had he done the program, but Neely \u201cskipped a compliance court date, and a warrant was issued for his arrest on Feb. 22.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of the 7-year-old, Neely \u201cpled guilty to endangering the welfare of a child and was sentenced to four months in jail,\u201d per the New York Daily News.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to reports, Neely had made the city\u2019s \u201ctop 50\u201d<a href=\"https:\/\/nypost.com\/2023\/05\/08\/jordan-neely-was-on-top-50-list-at-nyc-department-of-homeless-services-because-he-urgently-needed-help\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;list of homeless people<\/a>&nbsp;who were at risk and a danger to themselves and others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, this was a man with a history of dangerous and violent behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before Penny restrained Neely on the subway, Neely was<a href=\"https:\/\/abc7news.com\/jordan-neely-daniel-penny-new-york-subway-chokehold-video\/13218776\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;allegedly yelling<\/a>, \u201cI don\u2019t care if I die. I don\u2019t care if I go to jail. I don\u2019t have any food \u2026 I\u2019m done.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Penny couldn\u2019t have known about Neely\u2019s past behavior, of course, but his current behavior was disturbing enough that Penny and two other men\u2014<a href=\"https:\/\/twitter.com\/Liz_Wheeler\/status\/1655625658662367253\" target=\"_blank\" rel=\"noreferrer noopener\">one of whom was not white<\/a>\u2014felt like they should restrain him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMr. Neely had a documented history of violent and erratic behavior, the apparent result of ongoing and untreated mental illness,\u201d a statement by Penny\u2019s lawyer reads. \u201cWhen Mr. Neely began aggressively threatening Daniel Penny and the other passengers, Daniel, with the help of others, acted to protect themselves, until help arrived. Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Monday, Neely\u2019s family released a statement lashing out at the Marine who killed him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDaniel Penny\u2019s press release is not an apology nor an expression of regret,\u201d their statement read. \u201cIt is a character assassination and a clear example of why he believed he was entitled to take Jordan\u2019s life.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They said Penny acted with \u201cindifference\u201d toward Neely and \u201cnever attempted to help him at all.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What was Penny supposed to do? Where were these people when Neely was out on the streets, taking drugs and acting like a lunatic? Talk about indifference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following Neely\u2019s death, the head of the New York Metropolitan Transportation Authority said that riders<a href=\"https:\/\/www.ny1.com\/nyc\/manhattan\/public-safety\/2023\/05\/05\/mta-chairman-urges-new-yorkers-to--deescalate--on-subway-after-neely-s-death\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;should find a way<\/a>&nbsp;to \u201cdeescalate\u201d to prevent violence. Most try to, but that\u2019s not always possible when dealing with somebody high on drugs, mentally ill, or both.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I live in New York and travel frequently on the F line. Run-ins with street people exhibiting bizarre and vaguely threatening behavior aren\u2019t uncommon and they seem to be increasing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you ride the subway, people waiting for their train frequently put their backs to the wall or to beams so they don\u2019t get blindsided and shoved on the tracks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If something bad happens, I pray that someone like Penny is around to help deal with the situation. Even a strong, young man might have difficulty dealing with a deranged person on drugs if they turn physical and violent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I don\u2019t want to live in a society in which good men who act in those situations are<a href=\"https:\/\/thefederalist.com\/2023\/05\/05\/the-lesson-of-jordan-neely-your-courage-and-sacrifice-will-be-punished\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;ruthlessly and maliciously punished,<\/a>&nbsp;where you are only rewarded for being a coward or a victim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s tragic that Neely died, but from what we know now, there was no racial component to this incident and he wasn\u2019t killed by racism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Repeat offenders like Neely should either be in jail or in an institution caring for<a href=\"https:\/\/www.dailysignal.com\/2018\/05\/16\/our-approach-to-severe-mental-illness-endangers-everyone\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;those with mental illness<\/a>. Given his past behavior, Neely shouldn\u2019t have been on that train. Penny should have never been put in the position of having to make a snap judgment to restrain him or potentially risk his own life and the lives of other passengers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If Penny is actually charged, let\u2019s hope the jury will get all the facts and make the right call.
