Ron DeSantis (R-Fla.) announced a proposed \u201cDigital Bill of Rights\u201d on Wednesday that will ban TikTok and other social media platforms with ties to China at colleges, public schools, and in state government as well as protect Floridians against Big Tech surveillance and censorship.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.flgov.com\/2023\/02\/15\/governor-ron-desantis-introduces-groundbreaking-legislation-to-protect-the-digital-rights-and-privacy-of-all-floridians\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cDigital Bill of Rights\u201d<\/a>&nbsp;takes direct aim at certain platforms online to \u201cprotect Floridians from Big Tech harm and Big Tech overreaches,\u201d DeSantis proclaimed during a press conference that was held in West Palm Beach.<\/p>\n\n\n\n<p>\u201cWe want to protect your right as a Floridian to have private, in-person conversations without&nbsp;<a href=\"https:\/\/americanwirenews.com\/nsa-is-snatching-up-laid-off-big-tech-workers-from-meta-zoom-and-twitter-in-largest-hiring-spree-in-30-years\/\" target=\"_blank\" rel=\"noreferrer noopener\">Big Tech surveilling you<\/a>,\u201d DeSantis declared. \u201cIf you want to consent to let them have this information so they can fashion advertising based off of it, it\u2019s your right to consent to do so but it should only be if you consent.\u201d<\/p>\n\n\n\n<p>\u201cWe are also going to protect the right to participate in online platforms without unfair censorship,\u201d he added. \u201cWe want free speech.\u201d<\/p>\n\n\n\n<p>The conservative governor expanded on transparency in connection to search engines and steps taken to protect Floridians online.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Proud to be pursuing the most robust Digital Bill of Rights in the country. <a href=\"https:\/\/t.co\/hPD7pUEqnA\">pic.twitter.com\/hPD7pUEqnA<\/a><\/p>&mdash; Ron DeSantis (@GovRonDeSantis) <a href=\"https:\/\/twitter.com\/GovRonDeSantis\/status\/1625994068143611905?ref_src=twsrc%5Etfw\">February 15, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>\u201cWe want to protect the right to know how these internet search engines are manipulating search results [and have] transparency in terms of what they\u2019re doing so you can evaluate if that\u2019s a search engine that you want to use or maybe you want to take your business elsewhere,\u201d he explained.<\/p>\n\n\n\n<p>\u201cWe want the right to protect all of your personal information on the largest and most common platforms,\u201d DeSantis asserted, mentioning Google and Facebook specifically. \u201cThey take that data and make a fortune.&nbsp;<a href=\"https:\/\/americanwirenews.com\/wh-visitor-logs-indicate-a-very-cozy-relationship-with-big-tech-execs-critics-claim\/\" target=\"_blank\" rel=\"noreferrer noopener\">They should get authorization from you<\/a>&nbsp;before they are able to monetize that or use it in any way.\u201d<\/p>\n\n\n\n<p>\u201cAnd, finally, the \u2018Digital Bill of Rights\u2019 aims to protect children from various online harms and, as we know, that\u2019s a huge issue,\u201d the Republican icon stated, getting a round of applause.<\/p>\n\n\n\n<p>DeSantis went on to detail the aspects of the proposal, noting that the Sunshine State\u2019s government would no longer allow tech companies to collect information from personal conversations utilizing certain words and phrases to do so.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Our Digital Bill of Rights will ensure Floridians have the right to:<br>&#8211; Protect children from online harms <a href=\"https:\/\/t.co\/KE4xdYWWP5\">pic.twitter.com\/KE4xdYWWP5<\/a><\/p>&mdash; Ron DeSantis (@GovRonDeSantis) <a href=\"https:\/\/twitter.com\/GovRonDeSantis\/status\/1625972609169981502?ref_src=twsrc%5Etfw\">February 15, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>He also delved into what differs from the federal government listening in on devices via a wiretap, versus what private companies can do.<\/p>\n\n\n\n<p>\u201cSo, we\u2019re going to put in a roadblock that says they can\u2019t do that without your expressed authorization,\u201d he stated. \u201cWe\u2019re also going to prohibit the unauthorized data collection and retention of real-time information about a user through cell phones such as GPS location, biometric data, and other personally identified information.\u201d<\/p>\n\n\n\n<p>The \u201cDigital Bill of Rights\u201d is just one aspect of the governor\u2019s bigger push against Big Tech and the control they wield to censor users and control the content they promote, or the content they allow you to see on their platforms.<\/p>\n\n\n\n<p>\u201cA couple of years ago, we were the first state to take the lead to protect Floridians against Big Tech censorship and we passed legislation that did a couple of things,\u201d DeSantis noted. \u201cWe knew there would be litigation and would have to be decided by the Supreme Court but we decided some provisions of law that said these tech platforms and these social media companies are not \u2014 by their own admission \u2014 publishers.\u201d<\/p>\n\n\n\n<p>\u201cThey are not publishers, because if they were publishers, they would not get Section 230 liability from lawsuits so they hide under Section 230, saying they are not publishers, saying they are open forums, and yet, as we know with what has come out without a shadow of a doubt they are not functioning truly as open platforms,\u201d he charged.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Gov. So you have seen people who have conservative views marginalized entirely, banned, de-platformed, shadowbanned, and all these different things,\u201d DeSantis stated.<\/p>\n\n\n\n<p>\u201cSo, what we have said is in the state of Florida we have consumer protection and unfair trade practice laws. If you are advertising as being an open platform, you are taking that liability that says you are not a publisher, you\u2019re monetizing by taking people\u2019s data who join your services and then if you turn around and de-platform someone based on viewpoint, you\u2019re committing a fraud on the consumer. So, we wanted the Floridians who have been affected to be able to bring consumer fraud actions against Big Tech. We also empowered the attorney general of Florida to be able to police Big Tech if they were doing this.
